We lynched the landlord

jhnbrssndn:

Three months ago, I reported that my daughters’ former landlady was refusing to return their deposit of £1100 on spurious grounds, and claiming a further £1100 from them on the basis that the flat they had vacated was in such a poor state that she had lost a month’s rent pending repairs and redecoration.

In the UK, landlords have to register each tenancy with an independent Deposit Protection Scheme, and we referred to the scheme for an adjudication when it became clear that the landlady was steadfast in her refusal to return the girls’ money.

Today we got the decision from the adjudicator, who has thrown out the claim for the lost rent, and awarded the remaining £1100 overwhelmingly to us (£875 to us, £225 to the landlady).

I gather that the practice of trying to withhold deposits is rife.  But this shows that if you have an unscrupulous landlord, you can stick up for yourself and win.

In Ontario, they did away with Damage Deposits entirely - it’s illegal.  The deposit is now held against Last Month’s Rent, and the landlord owes 3% annual interest to the tenants on the amount.  They can’t withhold like that anymore - it’s like tenants got rights or something! :D
